These Terms of Service ("Terms") govern your access to and use of hardmoneylendersirvine.com (the "Site"), which is operated by Lead Skills, LLC ("we," "us," or "our"). By accessing the Site, submitting an inquiry, or otherwise using any service offered through the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

2. Our Role: Lead Generation Service

The Site is a lead-generation marketing service. We collect information you voluntarily submit and share it with one or more participating hard money lenders in our network who may contact you about financing. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions, including loan approval, rates, terms, and funding timelines, are the sole responsibility of the participating lender. A current list of participating lenders is available upon request.

3. No Offer or Solicitation

Information on this Site is for general informational purposes only. Nothing on the Site is an offer to lend, a commitment to lend, or a solicitation of a loan. Submitting your information does not guarantee that you will be matched with a lender or receive a loan offer. All loan programs are subject to borrower and property qualification by the participating lender. Rates, terms, and conditions vary by lender and are subject to change without notice. Not all applicants will qualify.

4. Eligibility

To use the Site and submit an inquiry, you must:

• Be at least 18 years of age
• Be legally authorized to conduct business in the United States
• Have the capacity to enter into a binding contract
• Provide accurate, current, and complete information

5. Your Consent to Be Contacted

By submitting an inquiry and checking the consent checkbox, you provide your prior express written consent for one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry. You understand your information will be shared with one or more participating lenders who may contact you. Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply. Message frequency varies. You can opt out at any time by replying STOP to any text or calling 949-868-0320.

6. Equal Opportunity

We connect borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.

7. Acceptable Use

You agree to use the Site only for lawful purposes. You will not:

• Violate any applicable law or regulation
• Submit false, misleading, or fraudulent information
• Attempt to gain unauthorized access to the Site or its systems
• Interfere with the operation, security, or availability of the Site
• Harvest or collect information about other users
• Transmit malware, viruses, or other harmful code

8. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is owned by Lead Skills, LLC or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written permission.

THE SITE AND ITS SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PARTICIPATING LENDER WILL APPROVE YOUR INQUIRY, PROVIDE FINANCING, OR OFFER PARTICULAR RATES OR TERMS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEAD SKILLS, LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY INTERACTION WITH A PARTICIPATING LENDER OR THIRD PARTY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify, defend, and hold harmless Lead Skills, LLC and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Site, your submission of information, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of those courts.
